These Terms govern the conditions and procedures for using the hologram content marketplace and download service operated as HOLOFLEX (the “Service”), together with the rights and obligations of users and the operator.

1. Purpose

These Terms apply when a user registers an account to browse, purchase and download hologram content, and when a creator registers and sells content through the Service.

2. Definitions

“Content” means the hologram playback video file a creator uploads to the Service, together with its thumbnail and preview.
“Preview” means the short video published so that content can be examined before purchase.
“Source file” means the private video file supplied only to buyers.
“Download entitlement” means the standing of a buyer whose order has been approved to download the source file.
“Member” means a user who browses, purchases and downloads content; “Creator” means a user who uploads and sells content.

3. Publication and amendment of these Terms

These Terms are published on the Service at all times.

Where these Terms are amended, the effective date and the reason for the amendment will be announced in advance.

4. Registration and account types

An account is created when the applicant submits an email address, password and display name and agrees to these Terms and to the processing of personal data. The same applies to registration through a social account (Google).

Accounts are either Member or Creator, chosen at registration. Accounts created through a social account are created as Members.

Browsing content and previews (STORE)
Purchasing content and downloading source files
Re-downloading owned content (LIBRARY)
Adjusting the position, size and angle of purchased footage and downloading it again (STUDIO)
Content upload, editing and sales overview for Creators
HOLO KIT pre-orders and partnership or production enquiries from companies and IP holders

6. Content licence

A buyer may use downloaded content within the scope set out in these Terms.

The scope of commercial use, the limits on redistribution and resale, the status of works adjusted through holo fitting, and the licence term will be stated in this clause once determined.

7. Purchase and payment

Content prices are shown in Korean won (₩) in every display language.

An order placed by a buyer is approved after review by the operator, and the download entitlement is issued upon approval. Content priced at zero can be downloaded on sign-in alone, without an approval step.

Orders awaiting approval may be cancelled by the buyer. Order status and any rejection reason are shown in the purchase history.

8. Download entitlement

Source files are held in private storage and are served only through a time-limited link issued at the moment of download. Issued links expire after 1 hour.

A buyer holding a download entitlement may re-download the file from their library without a limit on the number of downloads.

9. Withdrawal and refunds

Withdrawal from a purchase and refunds are governed by the separately published Refund and Withdrawal Policy.

Any restriction on withdrawal arising from the nature of digital content applies only to the extent that the requirements of applicable law are met.

10. Creator obligations and settlement

A Creator may upload only content in which they hold lawful rights and is responsible for not infringing the rights of third parties.

Uploaded content is published after review by the operator; where it is rejected, a reason is provided.

The platform commission rate, settlement cycle and minimum payout will be stated in this clause once determined.

11. Restriction of use

Where a user infringes the rights of others or breaches applicable law or these Terms, content upload, purchasing and enquiry submission may be restricted, and published content may be taken down.

12. Limitation of responsibility

The operator is not responsible where the Service cannot be provided due to causes beyond its control, such as natural disasters, power failure or network outages.

The Creator who uploaded content is responsible for its substance and for holding the rights in it.

13. Territory, governing law and jurisdiction

The Service is offered to residents of the Republic of Korea and Japan. Compliance with the laws of other territories is not warranted for use from those territories.

These Terms are construed under the laws of the Republic of Korea; the competent court will be stated in this clause once determined.
